LuxeLoop Photobooths: Terms & Conditions
By booking our photobooth services, you (“the Client”) agree to the following terms and
conditions:
1. General Disclaimer
LuxeLoop Photobooths (“we,” “us,” or “our”) provides premium photobooth services,
including but not limited to Vogue Magazine Front Cover Booth, Glam Photobooth, Fun
Photobooth, Audio and Video Guestbooks, 360-degree Video Booth, and specialty setups.
While we strive to deliver a seamless and enjoyable experience, no guarantee is made that
services will be uninterrupted, error-free, or completely secure.
2. “As Is” and “As Available” Disclaimer
All services, websites, and materials are offered on an “as is” and “as available” basis with no
warranties, express or implied.
• We do not warrant that our services will be uninterrupted, timely, secure, or error
free.
• We accept no liability for software, hardware, or third-party service failures.
• Guests and clients use our services at their own risk, and we are not liable for
dissatisfaction or technical faults.
3. Assumption of Risk
Participation in our services is voluntary and at the participant’s own risk. LuxeLoop is not
liable for any injury, allergy, or damage from use of our equipment, props, or related services.
4. Limitation of Liability
To the fullest extent permitted under South African law:
• LuxeLoop, its employees, and affiliates will not be held liable for direct or indirect
damages resulting from the use of our services.
• We are not responsible for delays or failures due to factors outside our control,
including but not limited to road conditions, power outages, equipment malfunction,
weather conditions, or acts of God.
5. Booking, Cancellation & Refund Policy
• A non-refundable deposit of 50% is required within 7 days to secure your booking.
• Full payment must be made 30 days before the event unless agreed otherwise in
writing.
• Cancellations:
o 30+ days before event: partial refund (excluding deposit).
o Within 15 days: no refund.
• If we cancel due to unforeseen circumstances, you will be offered a full refund or a
reschedule at no cost.
6. Idle Time Clause
• Idle time is any period the booth is set up but not in use by client request.
• Idle time is billed at a reduced hourly rate and must be arranged in advance.
• Idle time does not extend the rental period unless additional time is purchased.
• Setup and breakdown are not considered idle time and are not charged unless early
setup is requested.
7. Data Protection & Privacy
• By using our booths, guests consent to being photographed or recorded.
• We may use media from events for marketing unless the client opts out in writing at
least 15 days prior to the event.
• Client data is securely stored and never sold or shared without consent.
8. Alcohol, Conduct & Supervision
• We reserve the right to deny service to intoxicated or disruptive guests.
• We are not liable for offensive or inappropriate content captured during booth use.
• Children under 12 must be supervised by an adult. LuxeLoop is not liable for injury or
damage caused by unsupervised children.
9. Outdoor Events & Weather Conditions
• LuxeLoop Photobooths offers outdoor photobooth services but is not liable for
disruptions due to weather conditions (e.g., rain, wind, extreme heat).
• The client must provide adequate shelter for our equipment at outdoor events. If
weather conditions prevent safe operation, we reserve the right to modify, pause, or
terminate the service without refund.
10. Setup, Transport & Venue Requirements
• The client is responsible for ensuring the event venue provides sufficient space, power
supply, and access for setup.
• The client will arrange for an appropriately sized space for the chosen PhotoBooth at
the event venue.
• The Client must provide a completely flat and even surface for the photo booth to be
placed on, with no significant inclines or unevenness, to ensure proper operation and
prevent damage to the equipment; essentially, a stable area without any bumps or
dips.
• Smoke Machine Proximity: Photobooths may not be placed within 5 metres of any
smoke, haze, or fog machine due to damage risk and picture quality.
• DJ Proximity: Audio and video guestbooks must not be placed within 5 metres of
any DJ speakers or high-noise equipment to avoid audio distortion or equipment
failure.
• Flower Arrangements Disclaimer: Luxeloop Photobooths does not provide any
floral arrangements or decorations. Clients are responsible for organizing their own
floral decor if desired.
• Additional fees may apply for:
o Stairs or inaccessible venues
o Extended load-in times
o Early setup requests
• Travel Charges: A transport surcharge will be applied at AA-approved rates per km
if the event venue is more than 15km outside our base in Uitzicht, Durbanville.
Distances are calculated using the shortest route on Google Maps from Durbanville.
• Accommodation: Due to the nature of events and extensive travel involved,
accommodation may be required for Luxeloop Photobooths staff depending on the
location and time of the event. Luxeloop Photobooths reserves the right to book own
accommodation for their staff. This will be communicated during the booking process
and is to be covered by the client where applicable.
11. Equipment & Property Damage
• Clients and guests are responsible for any loss or damage to our equipment caused by
negligence, misuse, or intentional acts.
• Repair or replacement costs will be billed to the booking client.
12. Custom Branding & Props
• Clients and guests are responsible for any damage to LuxeLoop Photobooths’
equipment, including but not limited to cameras, backdrops, props, and accessories,
caused by negligence, rough handling, or intentional misuse.
• The client who booked the service will be liable for repair or replacement costs in
such cases.
• No refunds are given on custom orders once production begins.
13. Changes to this Agreement
LuxeLoop Photobooths reserves the right to update or modify this disclaimer at any time
without prior notice. Continued use of our services after such modifications shall constitute
acceptance of the updated terms.
14. Governing Law & Jurisdiction
This Disclaimer & Limitation of Liability shall be governed by and construed in accordance
with the laws of South Africa. Any disputes arising from the use of our services shall be
subject to the exclusive jurisdiction of the South African courts.
15. Acknowledgment & Agreement
I, the undersigned, confirm that I have read, understood, and agree to LuxeLoop
Photobooths’ Terms & Conditions. I acknowledge responsibility for ensuring compliance and
accept all related liabilities.
